I think he's not happy with posting a picture of the car without his consent.
Not that I understand why he objects, as it just brings the name out to more people, so more people will know the car.

1. I believe "he" is a "she"
2. How do you come to this conclusion?

I'm going to be busy for the next 6-8 months. I must make contact with the builders of every puzzle car I've posted, and ask if it's OK to use pictures of them.  ::)

1) If so, I do apologize.
2) "I see that SMS TILBURY car (french roadster) was produced as puzzle without agrement." which I read as such. However, maybe she can enlighten us if our conclusion is right?

Does it mean I have to give back my point?
I know where the picture cames from, and we had lots of pictures from that site.
It seems that He\She is concerned about the puzzle more than the picture.
I hope everyone will respect the term of his\her message or we'll have to merge another repost.

Can we move this in the "Don't think I understood you right" thread?

I read that message over and over again, but I still can't get the point.
The picture cames from a french site and was taken from a pubblic road then, beside the site owner's or the photographer, there shouldn't be any copyright.
We are not using the (?) trademarks 'SMS' or 'Tilbur'y in any other products and we are not making any profit upon that.
We just post a picture of a car asking to ID it.
In which way are we damaging his\her interests?
We will respect the terms of the message because once a puzzle is done, there's no need to do it again but I don't think his\her claim can found any ground...unless he\she can explain better what is the real matter.
We are good people after all  ;D.

I visited the SMS Tillbury web site and it appears to me it is just a forum for owners.  It states that the creator of this car is deceased.  Seems to be a rant about a Spanish firm they believe is copying the car.  Just an opinion, but I think this Michele is just a car owner with a lot of loyalty to the brand and self appointed protector.

Hi,

Michèle alias Lynemary : it is I.
I am the daughter and heiress of Yves CHARLES, deceased 2008 november, creator of SMS Tilbury since 1976  ... SMS Tilbury car copyrighted INPI Paris 12.02.1985 N° 850609.
I am also SMS TILBURY Forum's webmaster.
As you can read on this forum :
"Tilbury deposit INPI Designs & Copyright
Given all that we can all read on the internet about the Tilbury and desires it arouses (again!) When his paternity, both from the different users of the license of those who plagiarize in such Hurtan Spain, giving themselves every fatherhood, in broad strokes of articles in newspapers or on internet sites and forums, I thought it useful to join the ad:
- Copy of the form certifying the deposit INPI designs in the name of Yves CHARLES at the date of 12.02.1985,
- Photos of the vehicle subject to the filing of drawings and models,
- Factsheet INPI on various copyright - the moral and economic - and their duration.

Of all these controversies, it follows that I have repeatedly, for some years, and even recently, browse websites with forums specifically to "demonstrate" that the real creator of Tilbury is Yves Charles, the only no longer here to defend himself and claim the right to respect for his years of work. And the only one who has never had internet ...

Things are now, certified "public" by presenting documents INPI, I think everyone will have a much more objective on various articles published and can afford to provide, if desired, its contribution enlightened ..."

"Hurtan: the art of so-cons : Hurtan, the Spanish manufacturer should the success of its two T2 and T2+2 to the SMS Tilbury he plagiarized, after buying a SMS Tilbury not approved, at Martin."

"Sergio Bertola and SB AVALON: sin through ignorance
The famous Italian interior designer Sergio Bertola Design has extended its range since 2002 with the creation of the Department Autos SL birthplace of SB AVALON: history born of a marriage whose unusual "ring finger" n is none other than ... SMS the Tilbury."

I'm not  "just a car owner with a lot of loyalty to the brand and self appointed protector".

If you go on forum, you have a translator to dispose... I have use it... sorry for bad translation : is Google !  ;)

Best regards.

That guy, Charlie, is a lady (sorry about that Ms. Charles).
I'll do it but I have to find a little time.
I believe this is a misunderstanding: some people believe that the fact that any object is man made gives its creator a sort of right tto forbid that it be photographed or had its image reproduced and published. That seems to be the case here (even extending to the fact that it even shouldn't be discussed) by the creator's daughter.
That it's not the case at all. I know a bit about this, my work being protected in the same manner.
I think that this assumption is wrong. What a deposit at the INPI (who takes care of these things in France) secures, in that case, is that no one is allowed to copy the Tilbury and build a car that would use it's design. Not what Ms. Carles implies here. From the moment a car is driven, shown in public places , it's perfectly OK to reproduce not the car itself, but its image. To make a puzzle with it, discuss its qualities or defects, praise it or mock it, etc... In French law, there is no such thing as an owner's agreement that we should need.
Of course, I understand perfectly that Ms. Charles is trying to protect her fateher's creation from being copied or duplicated like in the examples she gives. But that a quite another story.
Now I know that the builders of the Atomium in Brussels, for instance, began to protect the use of its image. I'm not sure if they have the right, I'm not a jurist.

In this country they have no right to control images they do not own.  Photos they didn't take, they don't own.

Sorry about the he/she mistake.

Anything that's on the Internet is already in the public domain.
Anyone trying to prohibit viewing/reproducing images from it is going to be on a hiding to nothing.
Sometimes copying the image is blocked (e.g. flickr) but there are always ways around that.
No court in the world is going to uphold a claim against someone who copied an image from the 'Net!

I don't think you're right.
She says the puzzle has been posted without her agreement and she doesn't want other puzzles posted without her agreement.  She says we know we must have the owner's agreement before publishing pictures...

Which planet does she live on?  Everyone would spend their entire lives chasing owners of pictures to ask if they can be published..  It's complete rubbish - as I said before they are already in the public domain so there is nothing whatsoever she is able to do about it.

I see what you mean, you point to the first post.

I'd rather had in this case the original text in French to make up my mind.
